Fourth Circuit Affirms Summary Judgment

Megan Freeman and Margaret Fonshell Ward had summary judgment affirmed in their client’s favor by the U.S. Court of Appeals for the Fourth Circuit. The underlying case involved a claim for injuries that occurred when the Plaintiff/Appellant stepped in front of a moving car being driven by a codefendant towing company’s employee. The towing company employee was in the process of picking up vehicles purchased by a used car dealer to transport them to the dealership. In the brief, Megan argued that the U.S. District Court for the District of Maryland property granted summary judgment to their client, the used car dealer, as there was insufficient evidence of control for a jury to find that a master-servant relationship existed between the dealer and the tow company employee for the purpose of vicarious liability. The U.S. Court of Appeals for the Fourth Circuit agreed and affirmed the decision.
